| 规范意义下我国司法解释的类型可以界分为解释、规定、规则、批复、决定五种。关于实践中司法解释存在的脱离个案进行规范抽象解释的现象，不少学者将其概括地描述为司法解释的"立法化"趋势。通过对不同类型司法解释的分析可知，规定、规则和批复型司法解释仍属于最高司法权力行使的应有之义；而决定、解释型司法解释则具有明显的准立法性样态，但本质上是一种特殊的授权性质的立法，其合法性来源于立法机关立法权的部分转授，而并非司法权本身的"立法化"延伸。在全面推进国家治理体系与治理能力现代化的大背景下，有必要在重述不同类型司法解释之定位的基础上，严格规制决定、解释型司法解释所依附的权力转授，以避免最高司法机关权力行使对立法权的过度侵蚀。 |

| In the normative sense, the types of judicial interpretation in China can be divided into five forms: interpretation, regulation, rule, approval and decision. In some practical instances,judicial interpretation offers the normative abstract interpretation without involving individual cases, which is generally described by many scholars as the legislative trend of the interpretation. Through the analysis of different types of judicial interpretations, it can be seen that the judicial interpretations of regulation,rule and approval still belong to the due meaning of the exercise of the highest judicial power, while the judicial interpretations of decision and of interpretation have obvious quasi-legislative form, which is in essence a special kind of authorized legislation, and its legitimacy comes from the partial delegation of legislative power of the legislature, rather than the "legislative" extension of judicial power itself. In the context of comprehensively promoting the modernization of national governance system and governance capacity, it is necessary to strictly regulate the power delegated by the judicial interpretations of decision and of interpretation on the basis of restating the positioning of different types of judicial interpretations, so as to avoid excessive erosion of legislative power by the power exercise from the supreme judicial organs. |
