| 网络犯罪具有网络的跨地域性、主体匿名性以及网络用语的模糊性等特性,这些特性使得网络共同犯罪中行为人之间的意思联络表现形式难以认定。基于共犯理论和社会网络理论,意思联络对于共同犯罪中行为人的归责具有重要意义。意思联络否定说突破了共犯理论;片面共犯说虽然承认意思联络是共犯的基础,但认为单方的犯意行为也成立意思联络,难以自圆其说;意思联络缓和说虽然在共犯基础上对意思联络进行缓和,但与普通意思联络并无较大区别。故上述观点均难以解决现实中网络共犯意思联络的问题。在网络共犯中,网络诈骗具备网络犯罪的特性。基于共犯理论框架,在具体认定上,网络诈骗共同犯罪需要在共犯理论基础上明确意思联络的时间要素、内容要素、对象要素、行为要素及程度要素。 |

| Online crime is characterized by trans-regional connectivity, the anonymity of participants, and the ambiguity of online language, which makes it difficult to identify the forms of intentional connection between perpetrators engaged in online joint crime. Based on the theories of joint crime and social network,intentional connection is of great significance for the attribution of responsibility among the perpetrators in the joint crime. The "denial theory" of the intentional connection breaks away from the theory of joint crime; The one-sided joint crime theory acknowledges that the intentional connection is the basis of joint crime, but also believes that the unilateral intentional act alone can also establish intentional connection, which lacks logical consistency; The "intentional connection moderation "theory moderates the intentional connection based on the joint crime, but remains similar to the ordinary intentional connection. Therefore, the above viewpoints are difficult to solve the problem of intentional connection in the online joint crimes. Among online joint crimes, online fraud exemplifies the traits of online crimes. Based on the framework of joint crime theory, in specific identification, it is necessary to clarify the elements of time, content, object, behavior and degree of the intentional connection in the online fraud joint crime on the basis of joint crime theory. |
