| 随着互联网司法的深化应用,当前司法实践亟需探索未成年人犯罪记录封存的数字化转型路径。现有制度面临封存主体分散导致数字平台建设缺乏统一性、制度规范含混致使档案处理标准存在分歧、规范空白致使涉罪档案监督体系不完善三重困境。因此,应构建以检察机关为主导的犯罪记录封存数字平台,通过"纸质电子一体化"的方式实现对数据的规范处理,还应确立"一机关全过程"的监督机制来强化执行保障。该路径既可解决主体分散与标准模糊的结构性矛盾,又能依托数字技术完善监督体系,最终推动未成年人司法保护制度的系统性升级,进而实现未成年人犯罪记录封存的时代化发展与数字化完善。 |

| With the deepening application of internet-based judicial practices, the current judicial practice urgently needs to explore a digital transformation pathway for sealing juvenile delinquency records. The existing system faces three major dilemmas: fragmented sealing entities leading to inconsistent digital platform construction, ambiguous institutional norms causing divergent standards for record processing, and regulatory gaps resulting in an incomplete oversight system for crime records. Procuratorial organs should establish a digital platform for sealing crime records,and achieve standardized data processing through an integrated "paper-electronic" model. Moreover, a supervision mechanism of "single-organ, ful-process" should be established to strengthen execution guarantee. This approach can address the structural contradictions arising from fragmented entities and ambiguous standards, improve the supervision system with the help of digital technology, and ultimately promote a systematic upgrade of the juvenile judicial protection system, so as to realize contemporary development and digital enhancement in the juvenile delinquency records sealing. |
