| 为回应赌博犯罪的国际化、网络化趋势,2020年两高一部出台的《关于办理跨境赌博犯罪案件若干问题的意见》规定了"洗码"型开设赌场罪,但什么是"洗码",以开设赌场罪论处的"洗码"其构成要件包含什么,这些直接关系到罪名成立的重要内容该司法解释并没有给出,理论界也鲜有论及。同时,《刑法》第303条中赌博罪、开设赌场罪、组织参与国(境)外赌博罪三个赌博相关罪名竞合交织,为司法实践准确认定犯罪带来了很多困难。文章通过分析"洗码"型开设赌场罪中"洗码"的构成要件来明确其认定方法,并由此展望了《刑法修正案十一》后的罪名适用。 |

| In response to the internationalization and internet-based trends of gambling-related crimes, the 2020 Joint Guidelines on Handling Cross-Border Gambling Crimes (issued by the Supreme People’s Court, Supreme People’s Procuratorate and Ministry of Public Security) stipulates "chip washing"(Xi Ma)type casino operation crime. However, the Guidelines neither define "chip washing" nor specify its constitutive elements for casino operation crimes, which are critical legal issues that remain unexplained in jurisprudence and little discussed in the theoretical circle. The three gambling-related offenses in Article 303 of Criminal Law(gambling crime, casino operation crime, and organizing overseas gambling crime) present overlapping elements, which complicates judicial determination. This paper analyzes the constitutive requirements of "chip washing" in casino operation crime to establish clear conviction criteria, while examining the application of these offenses in the post-Amendment XI to the Criminal Law. |
