| 目前,小产权房用益困境的既有对策包括但不限于土地征收转国有、集体经营性建设用地入市、宅基地"三权分置"的地方试点等,均有其理论抑或实践上的不足。小产权房城乡用益解禁的前提是在遵循土地公有制基础上实现宅基地及地上住宅的"放活"使用,而居住权这一用益物权能在私法框架内兼顾居住利益和房地资产效能,是实现小产权房跨城乡用益的关键。文章基于房地产权的独立性理论和房地一体流转的原则,融入居住权基本原理提出了"以居代购"的新对策,利用有偿设立居住权的方式实现小产权房城乡用益解禁。针对宅基地闲置房产的价值盘活和合资建房,总结出房主、居住权人、农村集体经济组织三方共同参与、利益平衡的可行方案,推动实现小产权房的城乡用益解禁,拓宽农村房地资产的有效盘活路径。 |

| Current solutions to the use dilemma of houses with limited property rights(e.g., land expropriation for state ownership, market entry of collective commercial construction land, local pilot programs for the "separation of three rights" in rural homesteads) suffer from theoretical or practical shortcomings. Deregulating urban-rural use of such houses requires "liberating" homesteads and the above-ground residences while adhering to public land ownership. The usufructuary right of habitation, balancing living interests and property efficiency within private law frameworks, is the key to cross-regional use. Based on the independence theory of real estate rights and the principle of unified property-land transfer, this paper integrates the fundamental principles of the right to residence and proposes a "habitation rights in lieu of purchase" model, deregulating use through paid habitation rights. For idle homestead properties and joint-venture housing, a tripartite feasible scheme—engaging homeowners, habitation right holders, and rural collective economic organizations—is proposed, which aims to deregulate urban-rural use of the houses with limited property rights, and expand effective pathways for revitalizing rural real estate assets. |
