| 基于特别没收程序与缺席审判程序的高度相似性以及刑事缺席审判程序较没收程序所具有的全面性、优越性，特别没收程序的存在备受质疑。但2018年修订的《刑事诉讼法》在增加缺席审判程序的同时仍旧保留了特别没收程序，这其中不免涉及到对特别没收程序存在必要性的考量。文章分别从目的学、体系学、法教育学三个角度对两程序所具有的内在逻辑关系以及外在规则体系进行了分析。特别没收程序是针对财产的处置，缺席审判程序是对人的处置。为丰富追赃追逃手段，一方面应理顺两程序在《刑事诉讼法》中的程序梯度关系，另一方面应推动两程序的协调与衔接，打造刑事一体化视域下的多元化庭审模式。 |

| Because of the high similarities between trial by default procedure and special confiscation procedure, together with the comprehensiveness and superiority of the criminal trial by default procedure compared with the confiscation procedure, the necessity of the latter is questioned. However, in the revised Criminal Procedure Law in 2018, even though the trial by default procedure was added, the special confiscation procedure was still retained, which involves the consideration about the necessity of latter. This paper analyzes the inner logical relationship and the outer regulation system of the two procedures from three aspects including studies of purpose, system and law education. The special confiscation procedure aims at the disposal of property, while the trial by default procedure deals with people. In order to enrich the means of fugitive pursuit and illegal asset recovery, it is necessary to clarify the procedural gradient relationship between the two procedures in Criminal Procedure Law on one hand. On the other hand, the coordination and connection of the two procedures should be further promoted to create a diversified trial modes from the perspective of criminal integration. |
